Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material brought on record.

By way of the instant applicant, the applicant has sought for quashment of the entire proceeding of CNR No.UPMD 0401045522021, Computer No. 06554 of 2021, Case No.4518/9 of 2021 (State of U.P. vs. Sartaz and others) initiated on the basis of chargesheet no.1162 of 2020 dated 20.11.2020 arising out of Case Crime No.566 of 2019 punishable under Section 420, 447, 427 IPC, Police Station Civil Line, District Moradabad.

At the very outset, learned counsel for the applicant has submitted that the applicant wishes to move bail application before the trial court and relinquishes the prayer for quashment.

Learned A.G.A. has no objection.

¶9

However, taking into consideration the facts and circumstances of the case, it is provided that in case the applicant appears before the court concerned within 15 days from today and moves application for bail, the same shall be considered and disposed of by the court below, if convenient, on the same day.

For a period of 15 days from today, no coercive action shall be taken against the applicant.

It is made clear that in the event no such application is moved within the time prescribed above, this order will be of no avail to the applicant.

With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
