Heard learned counsel for the applicant/petitioner and learned Government Advocate for the State.

Learned counsel for the applicant/petitioner has submitted that the present petition has been preferred seeking direction to the court below to expeditiously decide the application/complaint case no. 01 of 2020 under Sections 323, 498-A IPC and 3/4 of the Dowry Prohibition Act, P.S. Hathras Junction, District Hathras pending in the court of learned Judicial Magistrate, Hathras.

It is further submitted that the learned trial court vide its order dated 27.04.2021 has issued summons against the accused persons and on 10.08.2021, on non-appearance of the accused persons, bailable warrants were issued but thereafter again summoning orders have been issued vide orders dated 07.09.2021, 18.10.2021 & 09.12.2021, in place of issuing non-bailable warrants on account of nonappearance of the accused persons. It is further submitted that the applicant/petitioner is facing financial hardship but till date, no decision has been taken in the matter.

At this stage, learned counsel for the applicant/petitioner has confined his prayer to the extent that the court below may be directed to decide the matter within the stipulated time frame, as this Court may deem fit and proper.

Learned AGA has no objection to the aforesaid submission of learned counsel for the applicant/petitioner.

As the petitioner is facing financial hardship and it is the right of the litigant to get speedy justice, and hence it is expected that learned court below shall decide the matter expeditiously without granting any unnecessary adjournment to any of the parties and if any adjournment is sought by either of the parties, some short date may be given.

In view of above, the present petition under Section 482 Cr.P.C. is disposed of finally.
