Instant petition under Section 482 Cr.P.C. has been preferred by the applicants/petitioners for quashing of the criminal proceeding of Special Case No. 120/2021 arising out of Case No. 304/2019, under Sections 354A, 323, 452, 324 IPC and Section 7/8 POCSO Act and Section 3(1)(W), 3(1)(d) of SC/ST Act, Police Station Sikandara, District Agra arising out of the impugned charge-sheet dated 23.06.2019 as well as summoning order dated 04.01.2020 passed by Special Judge, POCSO Act/Additional Session Judge, court no. 9, Agra.

After arguing at some length, learned counsel for the applicants/petitioners has submitted that he does not want to press the petition and seeks liberty to file bail application before the learned trial court which may be decided in view of law laid down by Hon'ble Supreme Court in order dated 7.10.2021 passed in Petition for Special Leave to Appeal (Cri) No.5191 of 2021 Satender Kumar Antil versus Central Bureau of Investigation and another .

Learned AGA has no objection to the prayer made by learned counsel for the applicants/petitioners.

On due consideration to the submissions of learned counsel for the parties', it is provided that in case, the applicants/petitioners move bail application before the trial court within fifteen days' from today, the same shall be decided within a period of ten days thereafter, in view of law laid down in the case of Satender Kumar Antil versus Central Bureau of Investigation and another (supra).

The petition is disposed of accordingly.
