Heard learned counsel for the applicants, learned AGA for the State and perused the material on record.
This criminal misc. application U/s 482 Cr.P.C. has been filed to issue a direction for expeditious disposal of the bail application of the applicants in case crime no. 0467/2016, under Sections 308, 325, 323, 504 IPC, P.S. Ushait, District Budaun in criminal case no. 862/2017, (New Case no. 5250/2018), (State vs. Suresh Pal And Ors.) pending in the court of Judicial Magistrate-Ist, Budaun.
Learned counsel for the applicants is confining his prayer only for a direction to the court below for expeditious disposal of the bail application in accordance with settled principles of law propounded by Hon'ble Apex Court.
It may be observed that generally all bail applications have to be decided expeditiously in accordance with law, unless there is some legal impediment. In this connection, this Court has already issued C.L. No. 44/2004 dated 16th October, 2004 and C.L. No. 12869/Admin. G-II Dated: Allahabad: 04.09.2014 to the sub-ordinate courts. Thus, needless to state that in case applicants move an application before the concerned court below within a reasonable period in accordance with law, the same has to be decided by the court concerned expeditiously in accordance with settled principles of law.
With the aforesaid observations, the instant 482 Cr.P.C. application is finally disposed of.
