Heard learned counsel for the applicant and learned A.G.A. appearing for the State and perused the material placed on record.

This application under Section 482 Cr.P.C. has been filed with the prayer to quash impugned N.B.W. order dated 12.03.2019 passed in S.T. No.258 of 2013 (State Versus Kuldeep and others) arising out of Case Crime No.78 of 2013 under Sections 363 and 366 I.P.C., Police Station Gajraula, District Amroha, pending in the court of Additional Session Judge (POCSO), Amroha.

The prayer for quashing the order impugned is refused as there is no ambiguity or illegality therein.

However, it is provided that if the applicant files an application for cancellation of the non-bailable-warrant issued against him, the application shall be disposed off on merit and also in case, he appears and surrenders before the court below and applies for bail, the said application shall be considered and disposed expeditiously in accordance with law.

With the aforesaid observations this application is finally disposed of.
