Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.

This application under Section 482 Cr.P.C. is filed to quash the charge-sheet dated 28.09.2021 as well as cognizance order dated 30.11.2021 in Case No.18767 of 2021 (State Versus Alpesh Patel) arising out of Case Crime No.0265 of 2021 under Sections 406, 504 and 506 I.P.C., Police Station Jeeyanpur, District Azamgarh, pending in the court of Additional Chief Judicial Magistrate, Court No.11, Azamgarh.

Learned counsel for the applicant has submitted that he is not pressing the application for the prayer of quashing of the impugned charge-sheet, cognizance order as well as entire proceeding of the case. He is confining his prayer only for direction of expeditious disposal of the bail application in view of guidelines propounded in Satender Kumar Antil Versus Central Bureau of Investigation and another)(2021) 10 SCC 773.

In view of the submission made by the learned counsel for the applicant, the prayer for quashing impugned charge-sheet, cognizance order as well as entire proceeding of the case is hereby refused.

This application under Section 482 Cr.P.C. is disposed of with a direction that if applicant moves bail application before the court concerned, it shall be decided expeditiously in accordance with settled principle of law propounded by Hon'ble Apex Court.
