At the very outset, learned AGA has raised a preliminary objection regarding maintainability of the present application preferred under Section 482 Cr.P.C. challenging the order dated 11.08.2021 whereby an application preferred by the applicant under Section 319 Cr.P.C. has been rejected as the applicant has alternative statutory remedy to file a criminal revision.
At this stage, learned counsel for the applicant has submitted that applicant does not want to press the present petition and the same may be dismissed as withdrawn with liberty to file a criminal revision before the competent court of law.
As prayed, the present petition is hereby dismissed as not pressed with liberty to avail the appropriate remedy as available under the law.
