The brief facts necessary for disposal of this application are that opposite party no.2 filed an application under Section 156(3) of Cr.P.C. against the applicants on 16.5.2016 with the allegation of demand of dowry, in the court of Additional Chief Judicial Magistrate, Agra and the learned Magistrate has called the report from Police Station Sikandara and allowed the application moved by opposite party no.2 and the first information report in this regard was registered on the order of the Magistrate concerned at Police Station Sikandara, District Agra on 15.7.2016 at 15:10 p.m. in Crime No.0656 of 2016, under Sections 498A, 323, 504, 506, 406 I.P.C. and Section 3/4 of Dowry Prohibition Act against her husband Naveen Kumar Gupta, mother-in-law, father-in-law, sister-in-law alleging therein that they were demanding Rs.2,00,000/- and Air Conditioner and on account of non-fulfillment of dowry, they were harassing and maltreating after one year of marriage and has driven out her from the house on 21.6.2015. They were also taunting her by saying barren because of not giving birth of a child. The case was investigated and the charge-sheet under Sections 498A, 323, 504, 506, 406 I.P.C. and Section 3/4 of Dowry Prohibition Ac. The cognizance was taken by learned Special Chief Judicial Magistrate, Agra and the applicants were summoned for facing trial.
