The present petition under Section 482 Cr.P.C. has been preferred by the applicant/petitioner for quashing of the order dated 22.11.2021 passed by Chief Judicial Magistrate, Kannauj in complaint case no. 23/2020, under Section 203 Cr.P.C., P.S.- Thathiya, District Kannauj.
Learned Government Advocate has raised a preliminary objection regarding the maintainability of the present petition under Section 482 Cr.P.C. as remedy is available to the applicant/petitioner to file revision under Section 397 Cr.P.C.
At this stage, learned counsel for the applicant/petitioner has submitted that the applicant/petitioner may be permitted to withdraw the instant petition under Section 482 Cr.P.C. and it may be dismissed as not pressed with liberty to file a revision.
As prayed, the instant petition under Section 482 Cr.P.C. is dismissed as not pressed with liberty to avail the appropriate remedy, as is available under the law.
