The instant application under Section 482 Cr.P.C. has been filed with a prayer to issue direction to the court of Judicial Magistrate-Siddharth Nagar for expeditious disposal of Criminal Case No.2194 of 2018 (State v. Akbal & Ors.) (arising out of Case Crime No.1649 of 2017, under Sections 147, 323, 504, 506, 352, 452 and 427 IPC, Police Station-Jogiya Udaipur, District-Siddharth Nagar.
It is submitted by the learned counsel for the applicant that opposite party nos.2 to 5 are adopting the delaying tactics and the case is pending since the year 2018.
Considering the facts and circumstances of the case and material available on record, the court of Judicial MagistrateSiddharth Nagar is directed to decide the aforesaid case expeditiously, preferably, within a period of nine months from the date a certified/computer generated copy of this order is produced before him, in case, there is no legal impediment in deciding the aforesaid case, without granting any unnecessary adjournment to either of the parties.
With the aforesaid direction, the application under Section 482 Cr.P.C. is disposed of .
