Heard Sri Ram Krishna Yadav, Advocate, holding brief of Ms. Kali Azad, learned counsel for the applicants, Dr. S.B.Maurya, learned AGA for the State and perused the record of the case.

By way of the present application the applicant has made a prayer to direct the trial court to expedite the proceedings of Complaint Case No. 1791 of 2019 under Section 138 read with Section 142 N.I.Act and conclude the same, as expeditiously as possible, preferably within stipulated period of time.

Learned counsel for the applicant submitted that a complaint case was lodged in the year 2019 and the same is still pending. Certified copy of the order sheet has been annexed as Annexure-3 to the afÏdavit filed in support of the Application in order to demonstrate that the trial court is not proceeding expeditiously.

Learned AGA is having no objection if any such direction is given by this Court to conclude the

trial of the case.

I have heard learned counsel for the parties and perused the record of the case.

As applicant is the complaint of the present case and he has filed a complaint in the year 2019 under Section 138 N.I.Act which is still pending and in view of Section 143(3) N.I.Act proceeding of the trial relates to N.I.Act, should be concluded within six months from the date of filing of the application. Therefore, in view of the facts and circumstances of the case, trial court is directed to conclude the trial of the case, as expeditiously as possible, within a period of six months from the date of production of a certified copy of this order.

The instant application stands disposed of.
