By means of this 482 Cr.P.C. application the applicant is seeking a direction to the Presiding Officer, Additional Court, Varanasi to conclude and decide Complaint Case No.1494 of 2019, Shashi Bhushan Singh vs. Udai Pratap Sharma, under Section 138 N.I. Act, P.S. Cantt., District Varanasi pending before the Presiding Officer, Additional Court, Varanasi within three months.
It is argued that complaint of complainant is pending before the lower court since 2019. More than two years have passed. Copy of the ordersheet has also been appended at page 19 of the affidavit which shows that case is pending at the stage of evidence of P.W.1.
Considering the facts and circumstances of the case this application is therefore disposed of with a direction to the Presiding Officer, Additional Court, Varanasi, to consider and decide Complaint Case No.1494 of 2019 expeditiously preferably within a period of six months from the date of receipt of a copy of this order.
