The present application u/s 482 Cr.P.C. has been filed to quash the impugned cognizance order dated 02.11.2017 passed by Special Judge (E.C. Act) Agra in Criminal Misc. Case No.2166 of 2017 in Case Crime no. 0040 of 2017, under Section 135 Electricity Act, P.S.- Jagner, District- Agra.

It has been stated that the offence alleged is compoundable. The applicant is ready to settle the matter with the opposite party no. 2. Reliance has also been placed on a recent Supreme Court decision in the case of Suresh Ganpati Halvankar Vs. The State of Maharashtra & Ors. in Criminal Appeal No. 156 of 2018, decided on 22.1.2018.

Section 152 of Electricity Act dealing with the compounding is quoted herein below:-

"152. Compounding of offences.-

¶16

Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974), the Appropriate Government or any ofÏcer authorised by it in this behalf may accept from any consumer or person who committed or who is reasonably suspected of having committed an offence of theft of electricity punishable under this Act, a sum of money by way of compounding of the offence."

Learned counsel for the applicant submitted that the applicant has valid electric connection of LMV1 having a Connection No. 163691. He has no dues of electricity department and his bill is updated and paid to the department.

Learned A.G.A. and counsel for the Corporation have no objection with regard to the compounding if the requisite amount is deposited.

Considering the facts and circumstances of the case, I do not find any ground to quash the charge-sheet and summoning order, therefore, the prayer for quashing the same is hereby refused.

Needless to note that the applicant has statutory legal remedy under Section 152 of the Electricity Act to approach the competent authority under the Act and to apply for compounding.

In view of above, if the application for compounding as per Rules is moved on behalf of the applicant before the ofÏcer concerned and as sum of Rs.4000/- within two weeks is deposited which will be subject to the final order passed by the competent authority, it is expected that the application for compounding shall be considered and decided expeditiously in accordance with law within a period of six weeks.

The applicant shall thereafter approach the competent court below with a copy of compounding order for disposal of the case in accordance with law.

Till the application for compounding is decided by the authority concerned, no coercive action shall be taken against the applicant pursuant to Criminal Misc. Case No.2166 of 2017 in Case Crime no. 0040 of 2017, under Section 135 Electricity Act, P.S.- Jagner, District- Agra.

With these observations, the present petition is finally disposed of.
