Heard Sri Ganesh Kumar, learned counsel for the petitioner and perused the record.

Present petition under Article 227 of the Constitution of India has been filed seeking a direction to the Civil Judge(Senior Division), Basti to decide suit No.11 of 2013(Sudhir Kumar vs. Narendra Kumar Bhatiya) under Section 21(A) & (B) of U.P. Tenancy Act, 1972 within a stipulated time period.

It is submitted by learned counsel for the petitioner that the petitioner had filed suit under Section 21(A) & (B) of U.P. Tenancy Act, 1972 for release of house. The defendants had put in appearance before the Court below and filed written statement but on account of delaying tactics adopted by defendants-respondents, the suit could not be decided and is pending since 2013.

Without going into merit of the case, it is appropriate that the above case be decided expeditiously.

In view of above, Civil Judge(Senior Division), Basti/Court concerned is directed to decide the suit No.11 of 2013(Sudhir Kumar vs. Narendra Kumar Bhatiya) expeditiously, if possible within one year from the date of production of certified copy of this order without granting adjournment unnecessarily to either of the parties, unless there is any legal impediment.

With aforesaid direction, the instant petition under Article 227 of the Constitution of India is finally disposed of.
