Heard Sri Devesh Kumar Shukla, learned counsel for the petitioner and perused the record.
Present petition under Article 227 of the Constitution of India has been filed by the petitioner with the prayer to direct the Fast Track Court (Junior Division), Court No.1, Aligarh to conclude the proceeding of the Original Suit No. 373 of 2014 (Smt. Munni Devi vs. Veerpal Singh & others) within stipulated period of time.
It is submitted by the learned counsel for petitioner that the aforesaid suit filed by the petitioner for cancellation of sale deed is pending since 2014 and on account of delaying tactics adopted by the defendant-respondents the same could not be decided till date.
Considering the submissions of learned counsel for the petitioner and without going into merit of the case, the Civil Judge (Junior Division)/Fast Track Court, Court No.1, Aligarh is directed to decide the Original Suit No. 373 of 2014 (Smt. Munni Devi vs. Veerpal Singh & others), expeditiously in accordance with law after affording reasonable opportunities of hearing to the parties concerned, preferably within a period of one year from the date of production of certified copy of this order, without granting undue adjournments to either of the parties, unless there is any legal impediment.
With aforesaid direction, the instant petition is finally disposed of.
