Heard Sri Vijay Tripathi, learned counsel for petitioner and perused the record.

This petition under Article 227 of the Constitution of India has been filed by petitioner for expeditious disposal of interim injunction application (Paper No.6-C) filed in Original Suit No.1414 of 2018 (Shaheen Vs. Abdul Rajjak and others) pending in the court of Civil Judge (Junior Division), Sharki, Allahabad, within a stipulated period of time.

It is submitted by learned counsel for petitioner that petitioner had filed a suit for cancellation of sale deed and also filed an application for interim injunction (Paper No.6-C) on 29.5.2018. It is further submitted that defendants-respondents had put in appearance before the trial court but till date neither objection to the interim injunction application nor any written statement has been filed by the defendants-respondents. It is further submitted that on account of delaying tactics adopted by respondents, the application (Paper No.6-C) filed by petitioner for interim injunction is still pending since 2018.

Considering the facts and circumstances of the case and without commenting on the merits of the case, learned Civil Judge (Junior Division), Sharki, Allahabad is directed to decide the interim injunction application (Paper No.6-C) filed in Original Suit No.1414 of 2018 (Shaheen Vs. Abdul Rajjak and others), expeditiously in accordance with law after affording reasonable opportunities of hearing to the parties concerned, preferably within a period of six months from the date of production of certified copy of this order, unless there is any legal impediment.

With the aforesaid directions, the petition is disposed of.
