Heard learned counsel for the applicant and learned A.G.A. for the State as well as perused the record.

The accused-applicant seeks bail in Case Crime No.0091 of 2021, under Section 3/5/25 Arms Act, Police Station Laharpur, District Sitapur.

Learned counsel for the applicant submits that the applicant has been falsely implicated by the police. He has no criminal history. He is languishing in jail since 23.2.2021. False recovery of country-made pistol, cartridges etc have been shown to which there is no public witness.

Learned A.G.A. has opposed the bail prayer of the applicant but could not dispute the facts mentioned above.

I have considered the arguments advanced by learned counsel for the parties.

On due consideration to the arguments advanced by learned counsel for the parties, perusal of the record, and the facts that the applicant is in jail since 23.2.2021; the applicant has no criminal history; charge-sheet has been filed; without expressing any opinion on merits of the case I find it to be a fit case for enlarging the applicant on bail.
