Heard Sri Ashok Kumar Singh, learned counsel for the applicant and Sri Anurudh Singh, learned A.G.A. and perused the record.

The present application under Section 439 Cr.P.C. has been filed seeking bail in FIR No. 0078 of 2022, under Section 302 IPC, Police StationRamsanehighat, District-Barabanki.

3.The allegations in the F.I.R. against the accusedapplicant and two other accused persons are that on 12-02-2022, they had killed Sunil Kumar Chauhan @ Bhoori over a minor dispute in respect of some dance programme in the marriage of Renu in Village-Narainpur, district-Barabanki.

The accused-applicant was not named in the F.I.R. The complainant was not present at the time of the incident. However, the eye witnesses have specifically named the accused-applicant in the commission of offence. The specific role has been assigned to the accused-applicant of catching hold of the deceased while the role of assault has been assigned to two other accused persons.

The post-mortem report of the deceased would suggest the following ante-mortem injuries.

"1. Lacerated wound of the size 04cm x 01cm upper lip situated 1 cm away from RT angle of mouth.

2. Lacerated wound of the size 04 cm x 01 cm on lower lip situated 1 cm away from RT angle of mouth.

3.Lacerated wound of the size 04 cm x 0.7 cm (bone deep) on the RT lower joint situated at 03 cm. away from chinne.

4. Lacerated wound size 01 cm x 0.6 cm on the RT side tongue situated at 2 cm. away from the tip of tongue.

5. Lacerated wound size 2.5 cm x 01 cm on the RT forehead(bone deep) situated 05 cm away from root of nose."

The medical evidence also supports the prosecution case.

Considering the facts and circumstances of the case and also considering the heinous nature of offence in which a young person was mercilessly killed, this court does not find it appropriate to enlarge the accused-applicant on bail. The bail application of the accused-applicant, Pradeep Kumar @ Joginder Bahra, is hereby rejected.
