Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case due to ulterior motive. It is further submitted that the applicant is not named in the FIR. The FIR has been lodged against three named persons along with 22-25 unknown persons. It is next submitted that no incriminating article has been recovered from the possession of the applicant. The co-accused, Kayam Ullah, Israr Ahmad Khan @ Israr, Shujaat Ullah, Istekhar Ahmad, Muneef @ Abdul Muneef, Ibrar, have already been granted bail by coordinate benches of this Court vide orders dated 18.07.2022, 27.08.2021, 10.06.2021, 21.02.2022, 14.12.2021 and 06.08.2022 passed in Criminal Misc. Anticipatory Bail Applications Nos.223 of 2022, 6348 of 2021, 5161 of 2021,250 of 2022, 14575 of 2021 and 6336 of 2021. Therefore, the present applicant is also entitled for anticipatory bail. Learned counsel has further submitted that the applicant has a criminal history of one case, which has been explained in para 20 of the affidavit in support of the bail application. Learned counsel for the applicant undertakes that he will cooperate in the investigation failing which the State can move appropriate application for vacation of the interim protection.
