Heard Sri Karm Veer Yadav, the learned counsel for the petitioner and Sri Indrajit Shukla, the learned Standing Counsel for the State.

On the basis of written instructions, the learned standing counsel states that a new laboratory has been set up at Agra and permanent staff is yet to be posted there. In order to commence functioning of the laboratory, the petitioner, who is working on the post of Junior Analyst, has been attached in the drug laboratory established in the Government of India aided State Drug Control System Enforcement Project for proper conduct of the work of analysis of drugs, in the interest of work, only on a temporary basis. Similarly nine other Senior / Junior analysts drugs have been attached at other laboratory also.

In view of the aforesaid submission of the learned standing counsel, I do not find the order dated 2.6.2022, a copy thereof has been filed as Annexure 1 and which is under challenge in the writ petition, to be arbitrary.

However, it is provided that the representation submitted by the petitioner on 6.6.2022 against the order dated 2.6.2022 may be considered and disposed of by the opposite party no. 2 i.e. Commissioner, Food Safety and Drug Administration, U.P., Sector-C, Aliganj, Lucknow expeditiously, say within a period of two weeks from the date a certified copy of this order is produced by the petitioner before the authority concerned.

With the aforesaid directions, the writ petition stands disposed off.
