Heard learned counsel for the petitioners and learned State Counsel.

Submission of the learned counsel for the petitioners is that the land comprising in Khasra Plot No.75 situate at Jal Nigam Raod, Baalaganj (Balakganj), Lucknow which was recorded in the name of the predecessor in interest of the petitioner were acquired, however, neither their predecessor in interest, nor they have been paid any compensation.

Learned State Counsel, however, submits that as to whether the said land has been acquired or compensation has been paid or not, is the question of fact which needs to be ascertained before granting the prayer made by the petitioners in the writ petition.

In view of the aforesaid, the writ petition is finally disposed of with liberty to the petitioners to make an appropriate application to the Additional District Magistrate (L & A), Lucknow taking therein all the pleas which may be available to them and annexing therewith all documents on which they intend to rely. Once any such application is preferred, the same shall be considered by the authority concerned and appropriate decision shall be taken in accordance with law in respect of the grievance of the petitioners after perusal of the relevant records. The decision under this order shall be taken by the authority concerned within ten weeks from the date certified copy of this order is produced before him.
