Heard Shri Dinesh Kumar Pushpakar, learned counsel for the petitioners as well as learned standing counsel for the respondent nos.1 and 2 and perused the record.

By filing the instant writ petition, the petitioners have requested to issue an order or direction directing the respondent no.2 i.e. Board of Revenue, Uttar Pradesh, Lucknow to decide the Revision No. 2277 of 2018 (Ram Samujh and others Vs. Shivdas and others), under Section 219 of U.P. Land Revenue Act.

Learned counsel for the petitioners submits that the above mentioned revision was instituted by the opposite party nos. 3 to 5, however the same is pending before the opposite party no.2 since 2018 and no substantial progress has been made while there is no legal impediment in expeditious disposal of the same and thus a suitable direction be issued to the respondent no.2 to dispose of the above mentioned case expeditiously, within stipulated period of time fixed by this Court in accordance with law.

Learned standing counsel appearing for the opposite party no.2 fairly submits that he would not be having any objection if any direction pertaining to expeditious disposal of the case pending before the respondent no.2 is issued, however the same shall be issue subject to the cooperation of the parties.

Having regard to the order intended to be passed by this Court, issuance of notice to the private respondent nos. 3 to 5, is hereby dispensed with as any direction pertaining to the expeditious disposal of the case pending before the respondent no.2 would also be in their interest.

Thus, having regard to all the facts and circumstances of the case, the writ petition is disposed of with the direction to the respondent no.2 i.e. Board of Revenue, Uttar Pradesh, Lucknow to consider and finally decide the above mentioned case

expeditiously within a period of six months from the date of an authenticated copy of this order is placed before the authority concerned, strictly in accordance with law, subject to cooperation of the parties, after providing opportunity of being heard to the parties.

It is made clear that this Court has not considered the merits of the case.
