After the order was passed on 10.08.2021, learned counsel for the applicant before rising of the Court before lunch had made a mention and placed reliance upon the judgement of the Hon'ble Supreme Court in the case of Sonu @ Subhash Kumar Vs. State of Uttar Pradesh & Anr. passed in Criminal Appeal No.233 of 2021 and has stated that in the light of the said judgement the applicant is entitled for grant of bail.
Learned counsel for the applicant requests to show the decision of the Hon'ble Supreme Court in support of the prayer for bail. He was allowed the same and after informing the counsel for the complainant, who had appeared and took a week's time to study the case relied upon by the learned counsel for the appellant.
Heard both the parties and perused the decision of the Hon'ble Supreme Court in the case of Sonu @ Subhash Kumar (Supra), however, since the bail application had already been decided on 10.08.2021, no further order can be passed on the application already decided.
The bail application is rejected.
The applicant, if so advised, may move 2nd bail application.
