Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents; and perused the record.
This petition has been filed by the petitioner, who is languishing in District Jail, Meerut, in reference to Case Crime No. 275 of 2019, under Section 302 I.P.C., for being produced in police custody before the Principal Judge, Family Court, Baghpat for the purposes of presentation of divorce petition by mutual consent under Section 13-B of the Hindu Marriage Act.
The learned counsel for the petitioner himself, during the course of arguments, admitted that there exists a provision in the Jail Manual to produce a person in custody before Court or an officer in connection with legal proceedings. He fairly states that as of now those provisions have not been invoked by the petitioner.
In view of the above, after some arguments, the learned counsel for the petitioner prays to withdraw this petition with liberty to invoke those provisions.
The petition is, therefore, dismissed as withdrawn with liberty as prayed for.
