Heard learned counsel for the petitioner, the learned Standing Counsel for the State-respondents and perused the record.
Explosive licence of the petitioner has not been renewed by the District Magistrate, Jalaun and, therefore, the petitioner by this petition seeks a direction upon the respondent no. 2 to renew the licence.
By order dated 11.01.2019 counter affidavit was invited. In the counter affidavit it has been stated that the petitioner was found guilty in a criminal case registered against him as Case Crime No. 1354/10, under Section 5/9 (B) Explosive Act at P.S. Jalaun, in which he was punished. It is also stated in paragraph 6 of the counter affidavit that the application for renewal of licence was rejected by order dated 26.09.2018.
In the rejoinder affidavit, rejection of application for renewal of license is not denied.
In this petition there is no challenge to the order of rejection of the renewal application.
In view of the above, we decline to entertain the petition and the same is dismissed .
