Heard Mr. Deepak Kumar Jaiswal, learned counsel for petitioner and Mr. Azad Rai, learned counsel representing respondent-5, Gram Panchayat, Kona, who are available on audio/video link. Learned Standing Counsel representing respondents-1, 2 and 3 is also available.

Lalti Devi, the writ petitioner has approached this Court for a writ of Mandamus commanding respondent-3, Nayab Tehsildar Meja, Allahabad to decide restoration application dated 05.11.2003 filed in Case No.619 of 1983, (Mahendra Vs. Jugudi) subsequently registered as Case No.158/06/107/14/378/3/175/6/10/153 of 2007 (New No.31/75/132 of 1988-89).

Having heard learned counsel for petitioner, learned Standing Counsel and Mr. Azad Rai, learned counsel representing respondent-5, the Court is of the view that no useful purpose shall be served by keeping the writ petition pending.

Considering the fact that the restoration application is pending since 05.11.2003, i.e., for more than seventeen years, present writ petition is disposed of finally with a direction to respondent-3, Naib-Tehsildar, Tehsil Meja, District Allahabad to decide above-mentioned restoration application within a period of two months from the date of production of a certified copy/computer generated copy of this order before him which shall be filed by petitioner before respondent-3, Naib-Tehsildar, Tehsil Meja, District Allahabad by means of a notary affidavit.
