Heard learned counsel for the parties.
By the instant petition, petitioner seeks the following reliefs:
"A) Issue a writ order or direction in the nature of mandamus direct to the Sub-Divisional Magistrate, Tehsil Sadar, District Agra (respondent no. 3) to demarcate Gata Nos. 385 Kha Area 0.0200 Hectare and 386 Kha Area 0.2390 Hectare situated at Village Nanpur, Pargana Agra, District Agra and settled it's boundary preferably within fix time.
B) Issue a writ, order or direction in the nature of mandamus direct to the Sub-Divisional Magistrate, Tehsil Sadar, District Agra (respondent no. 3) to decide the petitioner's representation dated 07.01.2021 and take appropriate action against the respondent no. 6 and 7."
Learned Standing Counsel, at the outset, submits that the third respondent, Sub-Divisional Magistrate, Tehsil Sadar, District Agra, shall pass appropriate order on the representation of the petitioner, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the third respondent, Sub-Divisional Magistrate, Tehsil Sadar, District Agra to consider the application for demarcation of the petitioner, expeditiously, preferably, within three months from the date of filing of a fresh application in accordance with Rules along with a copy of the writ petition, in the presence of all the affected parties, provided there is no other impediment.
It is clarified that the Court has not considered the claim of the petitioner on merits.
