In the affidavit dated May 27, 2019 filed by the respondents in Writ-C No. 26097 of 2015 titled as Hetram and others v. State of U.P. and others, it has been stated that compensation could not be paid on account of pendency of litigation before the Additional Commissioner, Agra Division, Agra bearing Revision No. C. 2129 of 2018 pertaining to that land.

In view of the aforesaid fact stated by learned counsel for the State, there cannot be any direction to the State for payment of compensation to the petitioner at this stage. However, as and when the final decision is taken in the proceedings before the Additional Commissioner or any Court subsequent thereto interfering with the order passed by the revisional Court, if challenged, whosoever is found entitled to receive compensation, if any, shall be paid in terms thereof.

The present petition is, accordingly, disposed of.
