Petitioner challenges the order dated 6.10.2020 whereby his claim for compensation in lieu of alleged acquisition of his land for construction of road has been declined. The Authority found:

Pertinently, the Authority was dwelling on the representation directed to be decided vide order dated 27.8.2020 passed in Contempt Petition No. 2474 of 2020. Evidently, the findings arrived by the Authority is on the basis of physical verification and spot inspection wherein the petitioner was called upon to participate; however, for the reasons best known to him, he did not participate. Be that as it may, there is no cogent material on record to belie the findings recorded by the Authority. Report by a Lekhpal is of no avail as the same is prepared on 03.03.2020 exparte and in absence of the Authorities of the National Highways Authority of India. Whereas the order by the Authority is on the basis of later spot inspection through Lekhpal wherein the petitioner or his representative did not participate.
In view whereof, since the petitioner fails to establish any perversity in the findings, arrived by the Authority, we are not inclined to cause any indulgence.
Consequently, petition fails and is dismissed .
No costs.
