The present petition has been filed with the following prayers:-

"i. To issue a writ, order or direction in the nature of mandamus directing the respondents more particularly the respondent No. 3 to 5 to forthwith send the revenue record and map of the village-Hajara, Tehsil-Chhata, District Mathura, before the respondent No. 6-Assistant Record Officer, Mathura for the purposes of survey/record operation which is being carried in pursuance of the notification dated 12.09.2017, to secure the ends of justice.

ii. To issue a writ, order or direction in the nature of mandamus directing the respondent no. 3-District Magistrate Mathura to consider and decide the representation of the petitioner dated 21.11.20-20 for placing the revenue record and map of the village-Hajara, Tehsil-Chhata, District Mathura before the respondent No. 6-Assistant Record Officer, Mathura, for purposes of survey/record operation which is being carried in pursuance of the notification dated 12.09.2017, as expeditiously as possible preferably within the time stipulated by this Hon'ble Court."

This Court vide order dated 13.1.2021 had directed the learned Standing Counsel to obtain instructions in the matter. Today, when the matter is taken up, the learned Standing Counsel states that the record has already been transmitted to the concerned authority. The petitioner counsel however argues that the record at Annexure-1 and record at Annexure-3, which are in the possession of the Collectorate and the Tehsil authority respectively have not been transmitted.

The present petition is disposed off with a liberty to the

petitioner to file an appropriate application before the respondent no. 3, who shall ensure the transmission of the records in accordance with law from the officer concerned, under whose possession the record is maintained. The said exercise shall be completed as expeditiously as possible, preferably within a period of two months from the date of filing of a copy of this order before the respondent no. 3.

Needless to say that further steps as are required to be taken under law shall be taken after receipt of the documents, as directed above. In the event, the Hindi translation of the document is not available, the documents as they are shall be transmitted to the authority concerned.

The petition is disposed off in terms of the said direction.
