Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.

Notice need not be issued to the private respondent no.5 in view of the order proposed to be passed.

Learned counsel for the petitioner states that the petitioner, alongwith other aggrieved person including the Village Pradhan, made a complaint against the respondent no.5, Smt. Kiran Jaiswal (Mukhya Sevika)/Incharge of Child Development Officer, Block Brijmanganj, District Maharajganj alleging misbehaviour and illegal activities. On the said complaint, the respondent no.5 conducted the enquiry and submitted the enquiry report on 24.7.2020 before the respondent no.4 but till date, no final decision has been taken. So far as the grievance of the petitioner is concerned, he has already filed an application/representation dated 07.8.2020 before the respondent no.1/Director, Women and Child Development, Government of UP, Lucknow for issuing direction to the respondent no.4 to take appropriate action and punish the respondent no.5 in the light of the enquiry report dated 24.7.2020, which is still pending. He has confined his prayer only to the relief that his application dated 07.8.2020 may be considered by the appropriate authority.

Learned counsel for the respondents has no objection to the said prayer.

No useful purpose would be served in keeping the writ petition pending.

In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no.1 to decide the petitioner's application/representation in accordance with law after affording opportunity of hearing to the respondent no.5 within a period of six weeks from the date of production of a copy of this order before him.

The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the applicants alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.

The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
