Heard learned counsel for the petitioner and learned Standing Counsel for the State.
The petitioner has challenged the order dated 06.04.2021 passed by the Tehsildar, Tehsil Sahjanwa, Gorakhpur, rejecting the application of the petitioner for cancellation of backward class certificate issued to respondent nos. 5 and 6.
He has held that power to cancel caste certificate is not vested in him but the District Level Committee. Learned counsel for the petitioner states on instructions that he has already approached the District Level Committee. He submitted that the District Level Committee be directed to decide the matter expeditiously.
Having regard the submission made, we dispose of the writ petition by providing that the District Level Committee shall decide the dispute expeditiously, if the same is still pending before it. A copy of the instant order be placed before the respondent no.2, Chairperson of the District Level Committee for ensuring compliance.
