Heard learned counsel for the petitioners, learned standing counsel for the State-respondents and Shri Tarun Agrawal, learned counsel for the respondent nos.2 and 3.

Grievance of the petitioner is that an undisputed amount of Rs.35,39,318/- is due and payable by respondent no.2 to the petitioner since the year 2015 and despite reminders of the petitioner and the letters written by the District Magistrate/ District Election Officer, Deoria, payment is not being made.

Learned counsel for respondent no.2 fairly states that on instructions of the respondent no.2 that certain amount is due and payable to the petitioner which shall be paid to him within two months.

In view of the statement made by learned counsel for respondent no.2, we do not find any good reason to call for a counter affidavit and to keep the writ petition pending.

Therefore, with the consent of learned counsel for the parties, this writ petition is disposed of with a direction to the respondent no.2 to make payment of the undisputed amount within two months from today which according to the respondent no.2 is due and payable to the petitioner.
