The petitioner is before this Court for a direction to the Respondent No.2, Nayab Tehsildar (Kaptanganj) Tehsil Harraiya, District Basti, to decide the Case No.458/05576/2017, Computerized Case No.T-2017140105576 (Yashoda Vs. Ghan Shyam) filed under Section 34 L.R. Act related to Village Penda, Tappa Navai, Pargana Nagar Pashchim, Tehsil Harraiya, District Basti, within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Respondent No.2, Nayab Tehsildar (Kaptanganj) Tehsil Harraiya, District Basti, to consider and decide the aforesaid case in accordance with law after hearing all the parties concerned, preferably within a period of four months from the date of passing of this order.
