Record shows that survey plot No. 252 area 2 bigha 2 biswa situate in village Aailampur, district Aligarh was bhoomidhari holding of Dineshwar Singh, father of petitioners However, in the consolidation proceedings, land in dispute was found to be abadi and therefore name of petitioners was not recorded over the same. Consequently, petitioners raised their grievance and by virtue of judgement of this Court in Kamla Shankar Vs. Deputy Director of Consolidation passed in Civil Misc. Writ Petition No. 4950 of 1975, Deputy Director of Consolidation, Aligarh passed an order directing therein that names of petitioners be recorded in revenue record regarding the land in dispute. Subsequently, petitioners filed an application in terms of Rule 109 (A) of U.P. Consolidation of Holdings Rules 1953 which was registered as Application No. 535 of 2020. This application came to be allowed by Deputy Director of Consolidation, Aligarh, vide order dated 7.6.2021. Same has been brought on record by means of supplementary affidavit.
