Record shows that a suit under Section 229-B of U.P.Z.A. and L.R.Act was filed by contesting respondents. In the aforesaid suit, a compromise is alleged to have been filed by the parties on 04.09.1978. On the basis of compromise so filed, SubDivisional Officer decreed the suit by means of judgment and decree dated 07.09.1978. Feeling aggrieved by judgment and decree dated 07.09.1998, Shyam Prasad-petitioner herein filed a recall application which came to be allowed vide order dated 14.07.1983. The effect of same was that order dated 07.09.1978 passed by Sub-Divisional Officer came to be recalled. Consequently no compromise decree was in existence in suit under Section 229-B of U.P.Z.A. & L.R. Act. Against order dated 14.07.1983, whereby recall application was allowed, contesting respondents preferred a Revision before Commissioner of the Division, which came to be dismissed vide order dated 28.02.1990. Thereafter contesting respondents filed Revision before Board of Revenue against above mentioned orders which also came to be dismissed vide order dated 05.05.1993. The effect of aforesaid proceedings was that no compromise decree with regard to land dispute was passed in favour of contesting respondents, in the suit under Section 229-B of U.P.Z.A. & L.R. Act. Consequently, right, title and interest of petitioner in the land in dispute remained intact.
