Learned counsel for petitioners submits that feeling aggrieved by the allotment of chaks made in Provisional Consolidation Scheme, petitioners filed an objection under Section 20 of U.P. Consolidation of Holdings Act, 1953 before respondent-2. Since objections were filed beyond the period of limitation, consequently, an application under Section 5 of Limitation Act was also filed seeking condonation of delay. However, inspite of the fact that a period of more than four years has rolled by from the date of filing of aforesaid objection, same has not been decided till date. He, therefore, submits that non-disposal of afore-mentioned objection filed by petitioners even after expiry of four years from the date of filing, cannot be said to be justified in any manner. He, therefore, submits that interest of justice shall be served in case a direction is issued by this Court to respondent-2, Consolidation Officer, Katghara, DistrictJaunpur to decide time barred objection filed by petitioners in terms of Section 20 of U.P. Consolidation of Holdings Act, 1953. Consequently, mandamus as prayed for is liable to be issued by this Court.
