The submission of Sri Pramod Kumar Sinha, learned counsel for the petitioner is that the claim of the petitioner was not considered by the Deputy Director of Consolidation while passing the impugned order.

Sri Brajesh Shukla, learned counsel for the respondent no. 2 contends that the Deputy Director of Consolidation has allotted the chak to the petitioner in proportion to his share in Gata no. 495 which is road side land. He however does not dispute the fact that the case of the petitioner has not been considered by the Deputy Director of Consolidation.

With the consent of learned counsel for the parties the following is passed.

The order of the Deputy Director of Consolidation insofar as it allots the chak to respondent no. 2, Moharam Ali in Gata no. 495 which abutting the pitch road is concerned, is upheld. The claim of the petitioner in regard to allotments of chaks in Gata no. 491 and 494 shall be considered by the Deputy Director of Consolidation in accordance with law, after hearing necessary parties. The area allotted to the respondent no. 2, Moharam Ali in Gata no. 494 has been waived by the learned counsel representing Moharam Ali in court. The Deputy Director of Consolidation may consider the allotment of aforesaid area in Plot no. 494 to the petitioner.

With the aforesaid directions the writ petition is disposed of.
