Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

The petitioner is the wife of late Sri R.N. Singh, who was working as Sales Tax Officer. It appears that an extraordinary pension has been granted to the petitioner w.e.f 31.01.2008. Subsequently, from the record, it appears that extraordinary pension has been revised, and accordingly, petitioner submitted a representation to respondent no.4 for extending the benefit of revised pension. On the letter of petitioner, the Additional Commissioner (Accounts) Sales Tax, Uttar Pradesh, Lucknow wrote a letter to Special Secretary, Kar Evam Nibandhan, Anubhag-1, Lucknow on 05.10.2020 forwarding the representation of the petitioner.

The grievance of the petitioner is that respondent no.2 is sitting tight over the matter and has not yet taken any decision on the representation of the petitioner.

Learned Standing Counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioner.

Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.2-Special Secretary, Vitta Bikrikar, Anubhag-1, Lucknow alongwith the copy of this order downloaded from the official website of High Court, Allahabad, raising all her grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.

The writ petition is disposed off subject to the observations made above.
