Heard leaned counsel for the petitioner, learned Standing Counsel for the Sate and Sri Rahul Srivastava, learned counsel for the private respondent.
By the instant petition, the petitioner is seeking a direction to Administrative Judge of District Judgeship, Moradabad to decide the Appeal No. Nil of 2019 (Veer Singh v. State of U.P. and another) within stipulated period.
Sri Rahul Srivastava, learned counsel appearing for respondent, on instruction, submits that the appeal (annexure no.11 to the petition) has not been received. He further submits that the memo of appeal filed along with the writ petition can be considered and decided on merits provided the petitioner consents to that effect.
Learned counsel for the petitioner, on instruction, submits that the petitioner would have no objection in the event the appeal at annexure no. 11 is considered and decided by the competent authority.
In view thereof, on consent, the writ petition is disposed of directing the second respondent to ensure that the appeal is decided expeditiously by means of a reasoned and speaking order.
