Heard learned counsel for the parties.
It is not being disputed by learned counsel for the respondent that petitioner retired from the post of Sahkari Kurk Amin on 31.07.2014, however, the pension and post retiral dues have been paid belatedly on 19.08.2021, after a lapse of seven years without any fault on the part of the petitioner.
Learned counsel for the petitioner, at this stage, pressed the relief claimed in clause-II of the prayer clause, which reads as follows:
"II. Issue a writ order or direction in the nature of mandamus directing the respondents to pay interest in entire amount of the petitioner as prescribed in law."
Since it is not being disputed by the learned Standing Counsel that the payment was belatedly paid, petitioner is entitled to interest admissible at bank rate.
The writ petition is allowed directing the respondents/competent authority to compute and pay the interest on the belated retiral dues @ 6% per annum. The amount shall be computed and paid to the petitioner within two months from the date of service of copy of this order.
