The prayer made in the present petition is for quashing the notice dated 15.1.2021 whereby the petitioner has been asked to vacate the official quarter within a period of ten days form the date of receipt of notice.
Submission is that the petitioner had challenged the order of termination/removal dated 23.10.2020 by filing a statutory appeal on 17.11.2020 ,it has yet not been decided. It is then contended by the learned counsel for the petitioner that on account of dismissal/removal, the petitioner is facing financial crisis.
The prayer has been made to accommodate the petitioner for few months. On the undertaking given by the learned counsel petitioner on behalf of the petitioner, he is granted two months time to vacate the quarter-in-question.
The petitioner is, thus, directed to vacate the quarter on or before 12.4.2021 and handover the vacant possession of the quarter-in-question to the competent authority. In case, the petitioner fails to comply with the above direction, it is open for the competent authority to get it vacated by force.
The writ petition is, accordingly, disposed of.
