The present writ petition under Article 226 of the Constitution of India has been filed for direction to competent authority i.e. respondent no. 2 to decide the appeal of the petitioner dated 27.12.2018 within the stipulated period of time.
It is submitted by learned counsel for petitioner that the petitioner was serving as Platoon Commander in PAC and his services were terminated on 9.5.2017 by respondent no. 3- Deputy Inspector General of Police, P.A.C., Varanasi Region, Varanasi. Against that order, the petitioner filed an appeal along with an application for condonation of delay, which remain pending till date.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merit of the case and with the consent of the parties, the writ petition is disposed of with a direction to respondent no. 2-Inspecor General of Police East Zone, Luknow, to decide the appeal (annexed as annexure no. 9 to the writ petition) of the petitioner by reasoned and speaking order, within a period of six months from the date of production of computerized copy of this order.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
The writ petition is disposed of.
