Heard leaned counsel for the applicant and Sri Rakesh Kumar Verma, learned counsel for the opposite party no. 2 through video conferencing and learned A.G.A. for the State.

The applicant, by means of this application is seeking transfer of Case no. 73 of 2016 (old case no. 318/09/2016 (Smt. Guljare Jehra vs. Mohd. Arif Usmani) from the Court of F.T.C.-III, Moradabad R.R.L.C. to any other court of coordinate jurisdiction in district-Rampur.

Notices were issued in this matter on 17.1.2020.

Sri Rakesh Kumar Verma, learned counsel for the opposite party no. 2 has apprise the Court that the matter has already been decided by the Court below by passing ex-parte order on 24.7.2018, when opposite party no. 2 had not put in appearance in the Court and the order dated 24.7.2018 has not been recalled till date, the transfer application is misconceived and devoid of merit and is liable to be rejected.

Considering the facts and circumstances, the transfer application is accordingly rejected.

The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioners along with a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.

The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing. Order Date :- 6.7.2021 Faridul
