supported the prosecution case. Another witness of last seen Sandeep Yadav was not produced by the prosecution in evidence. So far as the evidence of prosecutrix is concerned, she deposed as PW-5. She stated that on the date of occurrence, she had gone for defecation where Vijay Pratap, Awdhesh Yadav, Pushplata and Narendra Bahadur met her and they tucked a piece of cloth in her mouth and brought her to Lucknow in a Jeep where she stayed at the house of sister of accused Awdhesh Yadav for 15-16 days. She was kept locked in a room. During this period she had neither taken bath nor changed her cloth. The trial court has held that contrary to the statement of prosecutrix, Narendra Bahadur, who is father of accused Awdhesh Yadav was present at his house on the date of occurrence when the informant had visited his house in search of prosecutrix. It has also been found that the prosecutrix travelled with accused to various public places and was stayed at Lucknow for 15-16 days but she did not raise any voice for help or tried to run away from the place of her detention. It has been opined by the Doctor that physique of prosecutrix was well built and she was habitual of sexual intercourse. It has not been shown that when and from where the police had recovered her. On the point of kidnapping and rape, there is sole evidence of prosecutrix which was not supported by any other corroborative evidence or circumstances, therefore, the trial court acquitted the accused Awdhesh Yadav with conclusion that prosecution had failed to prove the charges against accused beyond shadow of doubt.
