Heard learned counsel for the petitioner and Shri G.P. Singh, learned AGA.

Present writ petition has been preferred for quashing the FIR dated 22.09.2021 being Case Crime No.86 of 2021 under Section 120-B, 406, 409, 188, 419 & 420 IPC at P.S. Jigna, Distt. Mirzapur and for a direction to respondents not to arrest the petitioner pursuant to aforesaid FIR.

On the matter being taken up on 09.11.2021, the Court has proceeded to pass the following order:-

"In the midst of arguments, learned counsel for the petitioner has placed reliance to the letters dated 25.10.2021 and 3.11.2021 sent by Manager (Proc.), Food Corporation of India to the Divisional Manager, Food Corporation of India, Divisional Office, Varanasi.

On the request of learned counsel for the petitioner, the case is passed over for enabling him to bring on record the aforesaid letters.

Put up again as fresh on 15.11.2021.

A copy of the aforesaid letters dated 25.10.2021 and 3.11.2021 may be supplied to Shri G.P. Singh, learned A.G.A. during the course of the day for enabling him to seek appropriate instructions."

On the matter being taken up today, learned AGA has relied upon the certificate issued by the District Manager, PCF, Mirzapur, which for ready reference is quoted as under:-

On the basis of instructions, learned AGA further apprises to the Court that so far as deficiency of foodgrains, as per the aforesaid certificate, the same has already been made good and at present there is no grievance left to the department concerned.

Considering the facts and circumstances of the case, no useful purpose would be served in keeping the writ petition pending consideration. With the consent of parties, the writ petition stands disposed of asking the investigating officer to proceed strictly in accordance with law but certainly taking into consideration the aforesaid certificate as has been relied upon/ produced by learned AGA.
