Heard learned counsel for the petitioner and the learned A.G.A. for the State - respondents.
This writ petition has been filed praying for the following relief :-
"(i) Issue a writ, order or direction in the nature of Certiorari to quash the impugned Chalani report dated 12.10.2020 registered as case crime no.78 of 2020 under section 110(G) as well as notice under section 111 Cr.P.C. which is initiated by the respondent nos.2 & 3 ((Sub Divisional Magistrate, Amaria) dated 19.10.2020."
Learned counsel for the petitioner submits that against the impugned order an application under Section 482 Cr.P.C. lies and the writ petition is not maintainable. He, therefore, prays that the writ petition may be dismissed as withdrawn with liberty to file an application under Section 482 Cr.P.C.
Without expressing any opinion on merits of the case of the petitioner, this writ petition is dismissed, as prayed by learned counsel for the petitioner. Liberty is granted to the petitioner to avail such remedy as may be available to him under the law.
