Heard learned counsel for the petitioner and the learned A.G.A. for the State - respondents.

This writ petition has been filed praying for the following reliefs:

"a) Issue a writ, order or direction in the nature of Certiorari quashing the First Information Report dated 13.12.2020 in Case Crime No.706 of 2020, under Section 7/13 Prevention of Anti Corruption Act, Police Station - Chandpur, District- Bijnor.

b) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 not to arrest the petitioner in pursuance of the First Information Report dated 13.12.2020 in Case Crime No.706 of 2020, under Section 7/13 Prevention of Anti Corruption Act, Police Station - Chandpur, District- Bijnor."

In the impugned First Information Report allegation has been made against the petitioner by the informant - respondent no.4 that the petitioner being the Investigating Officer of Crime Case No.102/2020 dated 26.02.2020 under Section 504, 506, 354 Kha, P.S. - Chandpur, District - Bijnor, has abused his position and demanded bribe.

Learned counsel for the caveator - respondent no.4 has produced before us a copy of an inquiry report against the petitioner dated 23.07.2020, which was submitted by the Superintendent of Police (Traffic), District - Moradabad, in which conclusion has been stated as under :-

हलोकर नदनिजवंक 16.02.2020 ककी हलोनिज बतजयज। नदनिजजाँक 06.07.2020 कलो अनभियपुक्तगण कके एनिबलीडब्लनू प्रजप्त नकयके गयके हहै। उक्त शलीमतली निजलजयज कके पनत ममौ० आररफ पपुत अजलीज अहमद दजरज ननिवजसली ममौ० कजनि न ूगलोयजनि थजनिज शजहबजद जनिपद रजमपपुर दजरज नदनिजजाँक 14.05.2020 कलो थजनिज शजहबजद अनभियपुक्तगण दजरज नदनिजवंक 19.02.2020 कलो अनभियपुक्तगण दजरज वजदली कके घर सके सलोनिके कके जकेवर व 5,00000/- रूपयके लके जजनिके कके सम्बनन्धि मम मपु०अ०सवं० 193/20 न्धिजरज 392 भिज०द०नव० बनिजम सपुहहैल आनद 04 निफर कके नवरूद्ध पवंजलीककत करजयज गयज। लजसककी नववकेचनिज उ०ननि० शली रईश अहमद थजनिज शजहबजद जनिपद रजमपपुर दजरज नदनिजवंक 14.05.2020 कलो ग्रहण करतके हहए नववकेचनिज कके मध्य बयजनि वजदली , गवजहनि, ननिरलीक्षण घटनिजस्थल, अवललोकनि सली०सली०टली०वली० फपुटकेज, कके आन्धिजर पर नदनिजवंक 15.05.2020 कलो न्धिजरज 392 भिज०द०नव० कज नवललोपनि करतके हहए न्धिजरज 504/506 भिज०द०नव० ककी बढलोत्तरली ककी गयली। नववकेचनिज प्रचललत हहै।

यद्यनप नववकेचक दजरज नववकेचनिज कके मध्य सजक्ष्य सवंकलनि करतके हहए न्धिजरज 392 भिज०द०नव० कज नवललोपनि कर न्धिजरज 504/506 भिज०द०नव० ककी वकनद्ध ककी गयली हहै तथजनप नववकेचनिज कके मध्य उच्चजलन्धिकजररयखों कके मजध्यम सके प्रजप्त वजदली व गवजहजनि कके शपथपतखों कलो सजक्ष्य कके क्रम मम नववकेचनिज मम सनम्मललत कर गपुण -दलोर कके आन्धिजर पर नववकेचनिज ककी जजनिली चजनहए थली जलोनक नववकेचक शली रईस अहमद हजल तहैनिजत थजनिज कलोतवजलली जनिपद रजमपपुर दजरज निहली नकयज गयज। लजससके इनिकके दजरज नववकेचनिज मम लजपरवजहली नकयज जजनिज पररलनक्षत हलोतज हहै।

उलकेखनिलीय हहै नक मपु०अ०सवं० 102/20 न्धिजरज 354 ख/504/506 भिज०द०नव० व ¾ मपुनस्लम मनहलज सवंरक्षण अलन्धिननियम-2019 थजनिज चजजाँदपपुर जनिपद नबजनिमौर व मपु०अ०सवं० 193/20 न्धिजरज 392 भिज०द०नव० थजनिज शजहबजद जनिपद रजमपपुर कके वजदली - प्रनतवजदली आपस मम ररश्तकेदजर हहै लजनिकके दजरज एक -दनूसरके कके नवरूद्ध अलग-अलग जनिपदखों मम अनभियलोग पवंजलीककत करजयके गयके हहै। उक्त दलोनिखों अनभियलोगखों ककी ननिष्पक्ष/पजरदशर्शी नववकेचनिज एक हली नववकेचक सके करजयज जजनिज समलीचलीनि प्रतलीत हलोतज हहै। जहजजाँ तक मपु०अ०सवं० 102/20 थजनिज चजजाँदपपुर कके नववकेचक उपननिरलीक्षक शली सतकेनद्र निजगर दजरज मपुकदमम मम अननतम ररपलोटर लगजनिके कके निजम पर अनभियपुक्तगण सके 65000/- रूपयके लकेनिके व 80000/- रूपयके ककी मजवंग करनिके कज प्रश्नि हहै तलो जजजाँच कके मध्य गवजह शली रजजकेनद्र लसवंह व डज० रहलीश अहमद कके दजरज 15000/- रूपयके एववं आवकेदक अजलीज अहमद , शलीमतली जजफरली, शलीमतली लसतजरज, जमलील अहमद, परवकेज खजजाँ, अकरम दजरज 50000/- रूपयके नववकेचक सतकेनद्र निजगर कलो दकेनिके ककी अपनिके बयजनि मम पपुनष्ट करतके हहए नववकेचक दजरज अनतररक्त पहैसके ककी मजवंग करनिज बतजयज गयज। ग्रजम प्रन्धिजनि रजजकेनद्र लसवंह व उप ननिरलीक्षक शली सतकेनद्र लसवंह निजगर दजरज जजवंच कके मध्य अपनिके-अपनिके बयजनिखों मम कजजाँल ररकजनडरग मम नववकेचक दजरज डकेढ़ (लजख रूपयके) ककी मजजाँग करतके हहए अमयजरनदत भिजरज कज प्रयलोग नकयज जज रहज हहै।

इस प्रकजर जजजाँच कके मध्य उपलब्न्धि अनभिलकेखलीय सजक्ष्य कके आन्धिजर पर नववकेचक उपननिरलीक्षक शली सतकेनद्र निजगर दजरज प्रश्निगत मपु०अ०सवं० 102/20 न्धिजरज 354 ख/504/506 भिज०द०नव० व ¾ मपुनस्लम मनहलज सवंरक्षण अलन्धिननियम-2019 थजनिज चजजाँदपपुर मम नववकेचनिज कके दमौरजनि ननिनहत स्वजथर ककी प न ूतर हकेतपु प्रनतवजदलीगण सके डकेढ़ लजख रूपयके मजवंगके जजनिके हकेतपु दबजव बनिजनिके ककी पपुनष्ट हलोतली हहै। लजसकके ललए उपननिरलीक्षक शली सतकेनद्र निजगर थजनिज चजजाँदपपुर जनिपद नबजनिमौर दलोरली पजयके जजतके हहै। जजजाँच आख्यज सजदर अवललोकनिजथर प्रकेनरत हहै। पतजवंक पपु०अ०यजतज०-प्रज०पत-23/2020 नदनिजवंक जपुलजई 2020

Learned counsel for the caveator - respondent no.4 further submits that the aforesaid report of the Superintendent of Police (Traffic), dated 23.07.2020 has been obtained by his relative under the Right to Information Act, 2005 which was issued by the Superintendent of Police (Traffic), District - Mooradabad, vide letter date 24.08.2020. The copy of the aforesaid report

as produced by the learned counsel for the respondent no.4 is kept on record.

Considering the facts and circumstances of the case and the allegations made in the impugned First Information Report, we prima facie find commission of a cognizable offence.

Under the circumstances, we do not find any good reason to interfere with the impugned First Information Report in view of the law laid down by Hon'ble Supreme Court in the case of State Of Haryana and Others Vs. Bhajan Lal, 1992 AIR 604 and State Of Telangana Vs. Habib Abdullah Jeelani and others, 2017 (2) SCC 779.

For all the reasons aforestated, the writ petition is dismissed leaving it open to the petitioner to apply for bail.
