Heard Sri Arvind Kumar, learned counsel for the petitioner and Sri Pankaj Saxena, learned A.G.A.-I appearing for the Staterespondent.

The present petition has been filed for a direction to the respondent no.2-Sub Divisional Magistrate, Tehsil Meja, District Prayagraj to conclude the proceedings of Application No.21 of 2019 (Ashish Kumar Mishra v State of U.P. through District Magistrate, Prayagraj and Others), under section 133 of Code of Criminal Procedure, pending before the Sub Divisional Magistrate, Tehsil Meja, District Allahabad within a stipulated time.

Learned counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been appended alongwith the affidavit filed in support of the application, to contend that although several dates have been fixed but for some reason or other the case has been adjourned and the pendency of the proceedings is causing undue hardship to the petitioner.

Learned A.G.A. for the State-respondent has fairly stated that he has no objection, if the trial is expedited.

Having regard to the aforementioned facts and circumstances and without expressing any opinion on the merits of the case, the present petition is disposed of with an observation that the court below would make an endeavour to decide the aforesaid application in accordance with law as expeditiously as possible, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
