Heard Sri D.P. Tripathi, learned counsel for the petitioner, Sri Patanjali Mishra, learned A.G.A for State-respondents and Sri Mahendra Pratap Singh, learned counsel for informantrespondent no. 3.

This writ petition has been filed praying for the following reliefs:

"i. Issue a writ order or direction in the nature of certiorari quashing the impugned F.I.R. dated 30.4.2021 lodged by respondent no. 3 case crime no. 330 of 2021, under Section 420, 406, 467, 468, 471 IPC. P.S. Naubasta, Distt. Kanpur Nagar (Annexure No. 1) to this writ petition.

ii. Issue a writ order or direction in the nature of mandamus commanding the respondents not to arrest the petitioner in case Crime No. 330 of 2021, under Section 420, 406, 467, 468, 471 IPC. P.S. Naubasta, Distt. Kanpur Nagar.

iii. Issue a writ, order or direction which this Hon'ble Court may be deem fit and proper under the circumstances of the case."

After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the writ petition with liberty to apply for anticipatory bail/ bail.

Learned A.G.A. has no objection to the aforesaid request of the petitioner.

In view of the aforesaid, the writ petition is disposed off with liberty to the petitioner to apply for anticipatory bail/ bail as permissible under law and in accordance with law.

It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
